Recording Responsibility

Version 1 · Effective October 15, 2026 · SHA-256 8cb2920df1b48bb0dbb85eca5d352e07c35cca3e72b6e5c875b50ab81ca04045

Version 1. Effective October 15, 2026.

Autopen captures meeting audio only when you start it, sends it to our servers for transcription, and turns the transcript into notes. You decide when to use it, and you are responsible for using it lawfully.

What the law asks

Recording and transcription laws differ from place to place. In one-party places, generally, one participant (you) consenting is enough for conversations you're part of, where everyone is in a one-party place. In all-party places, generally, everyone in the conversation must agree before it's captured or transcribed. Some places have mixed or special rules; treat them like all-party.

On calls, the other people's locations matter too. Courts often apply the strictest rule among the places the participants are in, so a one-party location does not settle it for a remote meeting.

The law treats transcription like recording. It does not matter that no audio file is kept afterwards.

The simple habit

Tell everyone at the start: "I'm using Autopen to take notes. Is everyone okay with that?" Asking everyone at the start is the simplest habit, though some places and situations require more. If anyone objects, stop.

What Autopen keeps

Audio is encrypted on the device and in processing storage, used only to transcribe, and deleted when the transcript is final. If an upload fails or a retry stalls, our servers can hold it up to 24 hours (up to 24 hours plus the maximum recording length for a recording that finishes uploading on its own after you stop), and the device can keep a recovery copy for 7 days, after which Autopen removes it the next time it cleans up. Transcripts and notes stay in your account until you delete them or an applicable retention rule expires them. Autopen keeps no voiceprint.

Not legal advice

This is general information, not legal advice. Rules change, and details matter: who is in the conversation, where they are, and what they expect. You decide whether and how you may capture a conversation.

Your confirmation

  • I will use Autopen only in conversations I take part in, and I will tell the other participants that Autopen is taking notes.
  • I will get every consent the law or the situation requires before I start, and I will stop if anyone objects.
  • I understand that the law treats transcription like recording, even though no audio file is kept after transcription.

I accept responsibility for how I use Autopen.
